These Terms and Conditions ("Terms") form a binding agreement between you ("you", "user") and Minilands ("Minilands", "we", "us") for use of the Minilands Android app (com.minilands.app), https://minilands.in, and related services (the "Platform").

By creating an account, accepting these Terms in-app, or using the Platform, you agree to these Terms, the Privacy Policy, the Refund & Cancellation Policy, and the Investment Risk Disclosure.

1. ELIGIBILITY You must be at least 18 years old and competent to contract under Indian law. The Platform is intended for users in India. You represent that you are not barred from using financial / investment services under applicable AML, sanctions, or other laws. You must provide true, complete, and current information.

2. NATURE OF THE PLATFORM Minilands provides a technology platform that may facilitate discovery of listed fractional real-estate investment opportunities, identity verification (KYC), wallet funding through third-party payment gateways, investment tracking, rental / distribution credits where applicable, and withdrawal requests to a verified bank account.

Minilands is not a bank or deposit-taking company; not a stock exchange; not a mutual fund / AIF / portfolio manager (unless separately licensed and expressly stated); not a guaranteed-return or fixed-deposit product; and not a personal loan, payday loan, crypto exchange, or gambling service.

Property listings, projected yields, occupancy figures, and financial illustrations are informational only and are not promises of profit. Nothing on the Platform is legal, tax, financial, or investment advice.

3. ACCOUNTS AND SECURITY Registration may use email OTP and/or Google Sign-In. You are responsible for activity under your account. Keep credentials and device access secure. Notify help.minilands@gmail.com immediately of suspected unauthorised access. We may refuse registration, suspend, or terminate accounts for security, fraud, compliance, or Terms breaches.

4. KYC AND AML KYC is required before investments and withdrawals. You authorise Minilands and its verification partners to validate documents and information using lawful sources. Forged or altered documents are prohibited and may be reported to authorities.

5. WALLET, DEPOSITS, AND PAYMENTS The wallet holds balances for Platform use and is not a bank savings account. Deposits are processed by third-party gateways such as Razorpay. Wallet balances do not earn interest unless a specific programme expressly says otherwise. You must use payment instruments that belong to you and are lawfully funded.

6. INVESTMENTS Before investing, review the listing’s minimum amount, fees, holding period, distribution terms, legal structure, and risk disclosures. An investment confirmation is a binding commitment subject to successful payment, KYC status, unit availability, and compliance checks. Investments are typically illiquid. Exit is not guaranteed unless a listing expressly provides an exit mechanism.

7. DISTRIBUTIONS AND WITHDRAWALS Distributions (if any) depend on underlying property performance and are not guaranteed in amount or timing. Withdrawals go to your verified bank account after compliance checks. Typical processing is 3–7 business days, excluding bank holidays and fraud review holds. You are solely responsible for taxes on investments and distributions.

8. REFERRAL PROGRAMME Referral rewards, if offered, follow in-app programme rules. Self-referrals, fake accounts, and abuse void rewards and may cause account termination.

9. ACCEPTABLE USE You must not break any law; use the Platform for money laundering, fraud, or sanctions evasion; interfere with security or systems; scrape or reverse engineer without permission; impersonate others; or upload malware, illegal, or harmful content.

10. INTELLECTUAL PROPERTY Platform software, branding, listings content, and design are owned by Minilands or licensors. You receive a limited, personal, non-transferable licence to use the app lawfully.

11. INVESTMENT RISK DISCLOSURE Real-estate investments involve risk of partial or total loss of capital. Risks include vacancy, tenant default, construction delay, valuation decline, legal title issues, regulatory change, natural disaster, and market downturn. Past performance and projected yields are not guarantees. Distributions may be delayed, reduced, or zero. Minilands does not guarantee principal repayment, fixed returns, or liquidity. Invest only money you can afford to lose.

12. REFUND AND CANCELLATION Refunds and cancellations are governed by the separate Refund & Cancellation Policy published on the Platform.

13. DISCLAIMERS THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINILANDS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) platform fees you paid to Minilands in the 6 months before the claim; or (B) INR 5,000.

15. INDEMNITY You will indemnify Minilands against claims and costs arising from your breach of these Terms, unlawful use, false information, or infringement of third-party rights.

16. SUSPENSION, TERMINATION, AND ACCOUNT DELETION We may suspend or terminate access for Terms breaches, legal requirements, or risk management. You may request account deletion as described in the Privacy Policy / account-deletion instructions.

17. GOVERNING LAW AND DISPUTES These Terms are governed by the laws of India. Subject to mandatory consumer law, courts at Mumbai, Maharashtra, India have exclusive jurisdiction. Before filing a claim, contact help.minilands@gmail.com and attempt good-faith resolution for 30 days.

18. CHANGES We may update these Terms. Material changes may be notified in-app or by email. Continued use after the effective date constitutes acceptance.
